New Jersey regulates online casino games and poker under Article 6C of the Casino Control Act (N.J.S.A. 5:12-95.17 et seq.) and online sports wagering under N.J.S.A. 5:12A, with the Division of Gaming Enforcement (DGE) as regulator. Only Atlantic City casino licensees (or their licensed Internet gaming affiliates) can hold an annual Internet gaming permit, and online sports pools run through casino and racetrack sports wagering licensees; B2B platform and game suppliers must be licensed as casino service industry enterprises. Internet gaming equipment must sit in secure facilities in Atlantic City and players must be verified as physically present in the State and at least 21. From 1 July 2025 the tax on Internet gaming and online sports wagering gross revenue rose to 19.75% (from 15% and 13% respectively).

New Jersey licensing questions answered

Who regulates online gambling in New Jersey?

The New Jersey Division of Gaming Enforcement (DGE), part of the Office of the Attorney General, regulates Internet gaming and sports wagering. The Casino Control Commission grants casino licences based on DGE investigations.

Can an international operator get its own online casino licence in New Jersey?

No standalone B2C licence exists. An annual Internet gaming permit is issued only to an Atlantic City casino licensee or its licensed Internet gaming affiliate, so operators run their brands through a casino partner and must also be licensed or approved by the DGE.

Do B2B game and platform suppliers need a licence in New Jersey?

Yes. Suppliers of Internet gaming platforms and games are gaming-related casino service industry enterprises under N.J.S.A. 5:12-92a(1). They cannot do business while their application is pending unless the DGE Director grants a transactional waiver.

What is the tax rate on online casino and online sports betting in New Jersey?

Since 1 July 2025 Internet gaming gross revenue and online sportsbook gross revenue are each taxed at 19.75%. Internet gaming also carries a 2.5% investment alternative tax, and online sports wagering a further 1.25%.

What is the minimum age for online gambling in New Jersey?

Players must be at least 21. The Sports Wagering Act requires sports bettors to be 21 or older, and DGE guidance says no one under 21 may take part in any gambling activity.

Do servers have to be located in New Jersey?

Yes. The primary Internet gaming equipment must be in a secure facility owned or leased by the casino licensee in Atlantic City. Backup equipment may sit elsewhere only with DGE approval, and every wager must be accepted in Atlantic City.

Do affiliates need a licence in New Jersey?

Yes. Affiliates paid flat fees need vendor registration, while revenue-share affiliates and those paid on player deposits or wagers need an ancillary casino service industry enterprise licence.

How big is the New Jersey online gambling market?

DGE figures show USD 2.91 billion Internet gaming win and USD 1.15 billion online sportsbook revenue in 2025, about USD 4.06 billion in total.
