Peru regulates remote games (online casino) and remote sports betting under Law 31557 of 2022, as amended by Law 31806 of 2023, and its Regulation approved by Supreme Decree 005-2023-MINCETUR, with the regime in force since February 2024. The Ministry of Foreign Trade and Tourism (MINCETUR), acting through its Directorate General of Casino Games and Slot Machines (DGJCMT), authorises, supervises and sanctions operators. Operators need a separate six-year exploitation authorisation for each activity, while platforms, game programs, progressive systems and other components must be homologated on the basis of a certificate issued by an MINCETUR-authorised testing laboratory; suppliers must enrol in the Register of Linked Service Providers. Operators pay a 12% tax on net monthly gaming revenue administered by SUNAT, and MINCETUR closed its formalisation window for existing operators in August 2024 before moving to enforcement and blocking of unlicensed sites.

Peru licensing questions answered

Who regulates online gambling in Peru?

The Ministry of Foreign Trade and Tourism (MINCETUR) is the national authority for remote games and remote sports betting. It acts through its Directorate General of Casino Games and Slot Machines (DGJCMT), which authorises, supervises and sanctions operators, laboratories and betting halls. SUNAT administers the remote gaming tax.

Do B2B game and platform suppliers need a licence in Peru?

Yes. Suppliers of platforms, games, payment gateways and other components must enrol in MINCETUR's Register of Linked Service Providers, which is free and granted automatically. Their products must then be homologated on the basis of a certificate from an MINCETUR-authorised laboratory. Suppliers may only serve authorised operators, or they lose their registration.

Can a foreign company obtain a Peruvian online gaming authorisation?

Yes. Authorisations are available to Peruvian companies, Peruvian branches of foreign companies and foreign companies without a branch. A foreign applicant must first have a representative with powers registered in Peru's Public Registry.

How is online gambling taxed in Peru?

Operators pay the Tax on Remote Games and Remote Sports Betting at 12% of monthly net income (stakes minus prizes and refunds) after a 2% maintenance deduction. The tax is filed monthly with SUNAT. SUNAT has also stated a 1% ISC per bet for foreign operators acting as perception agents.

How long is a Peruvian online gaming authorisation valid?

Exploitation authorisations last six calendar years and can be renewed for the same period, with a separate authorisation for each activity. Platform homologations last two years and are renewable, while game programs and progressive systems are homologated indefinitely.

What domain must a licensed Peruvian gambling site use?

After Law 31806, authorised platforms must run on a domain ending in .bet.pe, .bet, .com, .pe or .com.pe.

What is the minimum age and self-exclusion scheme for online gambling in Peru?

Only people aged 18 or over may register. Operators must block anyone in MINCETUR's Register of Persons Prohibited from Accessing Gaming Halls and link to its registration page. They must also offer platform self-exclusion and player-set deposit and bet limits.

Are cryptocurrencies allowed for betting in Peru?

No. The law bars paying bets with cryptocurrencies, and the Regulation forbids operators from carrying out crypto transactions.
