Gibraltar regulates gambling under the Gambling Act 2025, which repealed the Gambling Act 2005 and came into operation on 1 April 2026 (except Part 5 on regulated individuals, ss.55-77). Licences are granted by the Licensing Authority (the Minister responsible for gambling) and supervision is carried out by the Gambling Commissioner, both through the Gambling Division of HM Government of Gibraltar. The Act defines three licence families: B2C Gambling Operator, B2B Gambling Operator (including aggregators, platform suppliers, direct-integration content suppliers and substantially outsourced fraud, CDD, ID-verification and CRM services) and Gambling Operator Support Services (marketing/affiliates, customer-funds handling and relevant company ownership). Licensees must keep a registered office and a sufficient substantive presence in Gibraltar. Businesses newly brought into scope were given a six-month transitional licence from 1 April 2026 to apply, and existing 2005 Act licences are treated as licences under the new Act.

Gibraltar licensing questions answered

Who regulates gambling in Gibraltar?

Licences are granted by the Licensing Authority, which is the Minister responsible for gambling. The Gambling Commissioner is the regulator and AML supervisor. Both work through the Gambling Division of HM Government of Gibraltar.

Which law governs online gambling in Gibraltar?

The Gambling Act 2025 came into force on 1 April 2026 and repealed the Gambling Act 2005. Part 5 on regulated individuals (ss.55-77) has not been commenced yet. Codes of practice issued under the 2005 Act remain in force until new ones replace them.

Do B2B game and platform suppliers need a Gibraltar licence?

Yes. B2B remote gambling services provided in or from Gibraltar need a B2B Gambling Operator licence. This covers aggregators, platform suppliers, direct-integration content suppliers and substantially outsourced fraud, CDD, ID-verification and CRM services. Content providers that reach Gibraltar licensees only through an aggregator need Commissioner approval instead, with a GBP 1000 fee.

What gambling duty applies in Gibraltar?

General betting duty and general gaming duty are each 0.15% of gross profit, and the first GBP 100000 is exempt. Betting intermediaries pay 0.15% of commission income. Duty is paid in quarterly instalments.

How much does a Gibraltar remote gambling licence cost?

A new B2C betting or gaming application costs GBP 30000. The annual fee per vertical is GBP 50000, 100000 or 200000, depending on annual gross yield. B2B applications cost GBP 10000-20000, with annual fees of GBP 20000-85000 depending on the service and tier.

What is the minimum gambling age in Gibraltar?

The minimum age is 18 for gambling and 16 for lotteries. Licensees must take all reasonable steps to prevent under-age play.

Do licensees need a physical presence in Gibraltar?

Yes. A corporate licensee must have its registered office in Gibraltar and keep a sufficient substantive presence there. The Licensing Authority can take into account equipment located in Gibraltar, local jobs and tax revenue.

Do affiliates need a licence in Gibraltar?
