Brazil licensed fixed-odds sports betting and online games ("bets") federally from 1 January 2025 under Law 13,756/2018 and Law 14,790/2023, with the Secretariat of Prizes and Betting (SPA) of the Ministry of Finance authorising 85 operators on .bet.br domains. On 25 September 2026 Provisional Measure 1,394/2026 took effect, prohibiting the operation, offer, intermediation and advertising of fixed-odds betting nationwide, including by offshore operators and under state lottery licences. No new authorisations may be granted, pending applications lapsed, operators must take sites and apps offline 10 days after publication and all federal and state authorisations are extinguished after 30 days, without refund of the BRL 30 million grant fee. Other lottery products authorised by law, such as the federal lotteries run by Caixa Econômica Federal, are not affected. B2B suppliers never needed their own licence, but their systems had to be certified by SPA-accredited labs.

Brazil licensing questions answered

Is online betting legal in Brazil?

No longer. Provisional Measure 1,394 of 25 September 2026 prohibits fixed-odds sports betting and online casino-style games, and their advertising, throughout Brazil, including offers from operators based abroad. Other lottery products authorised by law, such as the federal lotteries, are not affected.

What happens to operators that held a Brazilian .bet.br authorisation?

They cannot take new deposits, must take their websites and apps offline 10 days after the MP was published and must refund players in full. Their authorisations are extinguished 30 days after publication, and the BRL 30 million grant fee is not refunded.

How do players get their money back?

Unsettled bets are void and stakes are refunded without deductions, while prizes on bets settled before shutdown remain payable. Operators send CPF-level refund lists to their banks, which must refund players within 7 days to an account in the player name.

Did B2B game and platform suppliers need a licence in Brazil?

No separate supplier licence existed; only operators were authorised. Operators betting systems and online games had to be certified for Brazil by SPA-recognised testing labs, and operators remained liable for supplier content.

What was the tax on betting operators before the ban?

Operators paid 15% of GGR in statutory allocations from April 2026 (12% before), plus a monthly supervision fee by band and a one-off BRL 30 million grant fee. Players paid 15% income tax on annual net winnings above the first income tax band.

Can betting still be advertised in Brazil?

No. All advertising, marketing and sponsorship of fixed-odds betting aimed at the Brazilian public is banned, and existing material had to be removed within 10 days. Internet platforms and app stores must block such content and face fines of up to 10% of Brazilian revenue.

Is the ban permanent?

It was enacted as a provisional measure, which has immediate force of law but must be converted into law by Congress or it lapses. Suppliers and operators should monitor its passage in Congress.

How does self-exclusion work in Brazil?

SPA runs a centralised self-exclusion system where a person can block all authorised betting sites at once using their CPF and gov.br login, for 1 to 12 months or indefinitely. Operators had up to 72 hours to block excluded players.
